Privacy Policy

This global Privacy Policy describes our policies and procedures on the collection, use and disclosure of your information and personal data when you use Titania products/services or the Titania website anywhere in the world and tells you about your privacy rights and how the law protects you. 

We comply with applicable data protection and privacy laws in the countries in which we operate, including, to the extent they apply, the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018, the EU General Data Protection Regulation (EU GDPR) (together, “GDPR”), and the California Consumer Privacy Act (CCPA), each as amended from time to time. 

Definitions

For the purposes of this Privacy Policy:

Account

means a unique account created for You to access our Service or parts of our Service. 

Company

(referred to as either "the Company", "we", "us" or "our" in this Privacy Policy) refers to Titania Limited, 167-169 Great Portland Street, London, England, W1W 5PF. 

cookies

are small files that are placed on your computer, mobile device or any other device by a website, containing the details of your browsing history on that website among its many uses. 

device

means any device that can access the Service such as a computer, a mobile phone or a digital tablet. 

Personal Data

is any information that relates to an identified or identifiable individual. 

For the purposes of GDPR, Personal Data means any information relating to you such as a name, an identification number, location data, online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity. We also use Personal Data to refer to Personal Information as defined in the California Consumer Privacy Act (CCPA).

Consumer

means a natural person who is a resident of the State of California, as defined in the CCPA, when they interact with the Service in an individual or household capacity. 

Service

refers to Titania products and/or Titania.com

Service Provider

means any natural or legal person who processes Personal Data for or on behalf of the Company.  

This shall include third-party companies or individuals who may on behalf of the Company facilitate the Service, provide the Service, perform services related to the Service, assist the Company in analysing how the Service is used, directly contact you to enable provision of the Service or send marketing and advertising communications to you. For the purposes of GDPR, Service Providers are considered Data Processors. For example, we use HubSpot and Gartner to aid the running of our Service and to send marketing communications to you (either from us or direct from the Service Provider).

Usage Data

refers to data collected automatically, either generated using the Service or from the Service infrastructure itself (for example, the duration of a page visit). 

you/your

means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable. Where GDPR applies, you can be referred to as the Data Subject or as the User as you are the individual using the Service. Where CCPA applies, you may also be referred to as a Consumer

Collecting and Using Your Personal Data

While using our Service, we may ask you to provide us with Personal Data. This may include, but is not limited to: 

  • Email address 
  • First name and last name 
  • Phone number 
  • Address, State, Province, ZIP/Postal code, City 
  • Bank account information in order to pay for products and/or services within the Service 
  • Usage Data

Usage Data is collected automatically when using the Service. 

Usage Data may include information such as your device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data. 

When you access the Service by or through a mobile device, we may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data. 

We may also collect information that your browser sends whenever you visit our Service or when you access the Service by or through a mobile device. 

Use of Your Personal Data

The Company may use Personal Data for the following purposes (in each case in accordance with applicable data protection laws, including GDPR for users in the UK/EU and CCPA for California Consumers): 

  • To provide and maintain our Service: including to monitor the usage of our Service. This shall include any demos we may provide to you.  

  • To manage your Account: to manage your registration as a user of the Service. The Personal Data you provide can give you access to different functionalities of the Service that are available to you as a registered user. 

  • For the performance of a contract: to manage the development, compliance and undertaking of the purchase contract for the products, items or services you have purchased or of any other contract with us through the Service. 

  • To contact you: to contact you by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application's push notifications regarding updates or informative communications related to the functionalities, products or contracted services, including any security updates, when necessary or reasonable for their implementation. 

  • To provide you with: news, special offers and general information about other goods, services and events which we or our Affiliates, Service Providers and business partners offer (including personalised marketing and advertising on our own behalf or on their behalf) that are similar to those that you have already purchased or enquired about or that we believe may be of interest to youunless you have objected to or opted out of receiving such information as required under applicable law. 

  • To manage your requests: to manage any requests you send to us. 

  • To deliver targeted advertising and marketing to you: we may use your Personal Data to develop and display content, marketing and advertising (and work with third-party vendors, Affiliates, Service Providers and business partners who do so on our behalf or on their own behalf) tailored to your interests and/or location and to measure its effectiveness, subject to applicable consent, preference management and opt-out/"Do Not Sell or Share" requirements. 

  • For business transfers: we may use your Personal Data to evaluate or conduct a merger, divestiture, restructuring, reorganisation, dissolution, or other sale or transfer of some or all our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by us about our service users is among the assets transferred. 

  • For marketing purposes: we may use your Personal Data to send you marketing communications, if you have opted-in to receive such communications.  

  • For other purposes: we may use your Personal Data for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our service, products, services, marketing and your experience, and facilitating any reward scheme prizes which you may be eligible for. 

We may share your Personal Data in the following situations: 

  • With Service Providers: we may share your Personal Data with Service Providers to monitor and analyse the use of our Service, to show advertisements and marketing communications to you to help support and maintain our Service, to advertise on third-party websites and apps to you after you visited our Service, for payment processing, to contact you and to help provide or personalise marketing, advertising and promotional communications on our behalf or, where permitted by law, on their own behalf. 

  • For business transfers: we may share or transfer your personal information in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of our business to another company. 

  • With Affiliates: we may share your information with our Affiliates, in which case we will require those Affiliates to honour this Privacy Policy. Affiliates include our parent company and any other subsidiaries, joint venture partners or other companies that We control or that are under common control with us. Our Affiliates may use your information to help us provide, improve and market the Service, and, where permitted by law, to provide or personalise their own marketing, advertising and promotional communications, subject to applicable consent and opt-out requirements. 

  • With business partners: we may share your information with our business partners to offer you certain products, services or promotions and to allow them to provide or personalise marketing, advertising and promotional communications to you on our behalf or, where permitted by law, on their own behalf, subject to applicable consent and opt-out requirements (including any right to opt out of the "sale" or certain "sharing" of Personal Information under CCPA). We may also share your personal data to facilitate any reward scheme prizes which you may be eligible for. 

  • With your consent: we may disclose your Personal Data for any other purpose with your consent. 


Retention of your Personal Data

The Company will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies. 

The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer time periods. 

Transfer of Your Personal Data

 Your information, including Personal Data is processed at the Company's operating offices and in any other places where the parties involved in the processing are located. This means that this information may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction. 

The Company will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and applicable law. Where your Personal Data is transferred from the UK or EU to a country outside the UK or European Economic Area, we will implement appropriate safeguards as required under UK GDPR/EU GDPR (such as relying on an adequacy decision or entering into standard contractual clauses). We will also implement similar safeguards for international transfers as required under other applicable data protection and privacy laws. 

Disclosure of Your Personal Data

Business Transactions

If the Company is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy. 

Law enforcement

Under certain circumstances, the Company may be required to disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency). 

Other legal requirements

The Company may disclose your Personal Data in the good faith belief that such action is necessary to:

  • Comply with a legal obligation
  • Protect and defend the rights or property of the Company
  • Prevent or investigate possible wrongdoing in connection with the service
  • Protect the personal safety of users of the service or the public
  • Protect against legal liability

Security of Your Personal Data

The security of your Personal Data is important to us but no method of transmission over the Internet, or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security. 

Detailed Information on the Processing of Your Personal Data by Service Providers

The Service Providers we use may have access to your Personal Data. These third-party Service Providers collect, store, use, process, and transfer information about your activity on our Service in accordance with their own Privacy Policies. 

Analytics

We may use third-party Service Providers to monitor and analyse the use of our Service. 

Advertising

We may use Service Providers to show advertisements to you to help support and maintain our Service. 

Email Marketing

If you have opted-in, we may use your Personal Data to contact you with marketing or promotional materials and other information that may be of interest to you, including on behalf of or together with our Affiliates, Service Providers and business partners, in accordance with applicable laws. You may object to or opt-out of receiving any, or all, of these communications from us at any time by following the unsubscribe link or instructions provided in any email we send or by contacting us as set out in this Privacy Policy. 

We may use Email Marketing Service Providers to manage and send emails to you and, where permitted by law, they may also use your Personal Data to help provide or personalise marketing, advertising and promotional communications, subject to applicable consent and opt-in/"Do Not Sell or Share" requirements. 

Payments

We may provide paid products and/or services within the Service. In that case, we may use third-party Service Providers for payment processing (e.g. payment processors). 

We will not store or collect your payment card details. That information is provided directly to our third-party payment processors whose use of your personal information is governed by their Privacy Policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information. 

When you use our Service to pay for a product and/or service via bank transfer, we may ask you to provide information to facilitate this transaction and to verify your identity.

Behavioural Remarketing and Advertising

The Company uses remarketing and advertising services to advertise to you after you accessed or visited our Service. We and our third-party Service Providers use cookies and non-cookie technologies to help us recognise your device and understand how you use our Service so that we can improve our Service to reflect your interests and serve you advertisements and marketing communications that are likely to be of more interest to you, in accordance with applicable laws (including any requirement to obtain your consent for certain cookies or similar technologies). These third-party Service Providers collect, store, use, process and transfer information about your activity on our service in accordance with their Privacy Policies and to enable us to: 

  • Measure and analyse traffic and browsing activity on our service
  • Show advertisements for our products and/or services to you on third-party websites or apps
  • Measure and analyse the performance of our advertising campaigns

Some of these third-party Service Providers may use non-cookie technologies that may not be impacted by browser settings that block cookies. Your browser may not permit you to block such technologies. You can use the third-party tools to decline the collection and use of information for the purpose of serving you interest-based advertising.  

You may opt-out of all cookie based advertising from us by using the features of our cookie banner. 

We may share information, such as hashed email addresses (if available) or other online identifiers collected on our service with these third-party Service Providers. This allows our third-party Service Providers to recognise and deliver you ads across devices and browsers.  

GDPR Privacy

Legal Basis for Processing Personal Data under UK GDPR/EU GDPR 

Where UK GDPR or EU GDPR applies, we may process Personal Data under the following conditions: 

  • Consent: you have given your consent for processing Personal Data for one or more specific purposes e.g. direct marketing, non-essential cookies. 

  • Performance of a contract: provision of Personal Data is necessary for the performance of an agreement with you and/or for any pre-contractual obligations thereof, e.g. account creation, provision of services, billing.  

  • Legitimate interests: processing Personal Data is necessary for the purposes of the legitimate interests pursued by the Company e.g. product improvement, security, B2B marketing where allowed. 

In any case, the Company will gladly help to clarify the specific legal basis that applies to the processing, and whether the provision of Personal Data is a statutory or contractual requirement, or a requirement necessary to enter a contract. 

Your Rights under the UK GDPR and EU GDPR 

The Company undertakes to respect the confidentiality of your Personal Data and to guarantee you can exercise your rights under the UK GDPR and EU GDPR, where they apply. 

You have the following rights under this Privacy Policy, and by law if you are within the UK or EU, where UK GDPR or EU GDPR applies: 

  • Request access to your Personal Data: the right to access, update or delete the information we have on you. Whenever made possible, you can access, update or request deletion of your Personal Data directly within your account settings section. If you are unable to perform these actions yourself, please contact us to assist you. This also enables you to receive a copy of the Personal Data we hold about you. 

  • Request restriction of processing of your Personal Data: you have the right to ask us to suspend the processing of your Personal Data in certain circumstances, for example if you want us to establish its accuracy or the reason for processing it. 

  • Request correction of the Personal Data that we hold about you: You have the right to have any incomplete or inaccurate information we hold about you corrected. 

  • Object to processing of Your Personal Data: this right exists where we are relying on a legitimate interest as the legal basis for our processing and there is something about your situation, which makes you want to object to our processing of your Personal Data on this ground. You also have the right to object where we are processing your Personal Data for direct marketing purposes. 

  • Request erasure of Your Personal Data: you have the right to ask us to delete or remove Personal Data when there is no good reason for us to continue processing it. 

  • Request the transfer of Your Personal Data: we will provide to you, or to a third-party you have chosen, your Personal Data in a structured, commonly used, machine-readable format. Please note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you. 

  • Withdraw Your consent: you have the right to withdraw your consent to using your Personal Data. If you withdraw your consent, we may not be able to provide you with access to certain specific functionalities of the Service. 

Exercising of your UK GDPR/EU GDPR Data Protection Rights 

You may exercise your rights of access, rectification, restriction, erasure, objection, portability and withdrawal of consent by contacting us using the details set out in the "Contact Us" section below. Please note that we may ask you to verify your identity before responding to such requests. If you make a request, we will respond to you as soon as possible and within the timeframes required by applicable law. 

You have the right to complain to a Data Protection Authority about our collection and use of Your Personal Data, for example to the UK Information Commissioner’s Office (ICO) or to your local supervisory authority in the EU. 

CCPA Privacy (California)  

If you are a resident of California, you may have additional rights over your Personal Data (as defined as Personal Information under the California Consumer Privacy Act (CCPA)), as amended from time to time. This section supplements the other parts of this Privacy Policy and applies only to California Consumers. 

Subject to certain limitations and exceptions under CCPA, California Consumers have the right to: (a) know and access the categories and specific pieces of Personal Data we have collected about them, the categories of sources from which it is collected, the business or commercial purposes for collecting, using, selling or sharing it, and the categories of third parties to whom we disclose it; (b) request deletion of their Personal Information that we have collected, subject to applicable legal exemptions; (c) request correction of inaccurate Personal Data; (d) opt out of the “sale” or certain “sharing” of their Personal Data, including for cross-context behavioural or targeted advertising; and (e) not be discriminated against for exercising any of their CCPA rights. 

To exercise your CCPA rights, you may contact us using the details set out in the "Contact Us" section below and clearly state that your request relates to your CCPA rights. We may need to verify your identity before processing your request and may ask you to provide certain information consistent with applicable law. You may also authorise an agent to make a request on your behalf, subject to verification of the agent’s authority and your identity as required by CCPA. 

We do not use or disclose Sensitive Personal Information (as defined in CCPA) for purposes other than those permitted under CCPA. We do not knowingly sell or share the Personal Data of Consumers under 16 years of age. 

If you are a California resident, you have the right to lodge a complaint regarding our privacy practices with the California Privacy Protection Agency (CPPA) or with the California Attorney General. You may also have similar rights under the privacy laws of other U.S. states, and you can contact your state’s Attorney General or privacy regulator if you believe your privacy rights have been violated.

"Do Not Track" Policy as Required by California Online Privacy Protection Act (CalOPPA)

California law requires us to let you know how we respond to web browser Do Not Track (DNT) signals. Because there currently is not an industry legal standard for recognising or honouring DNT signals, we do not respond to them currently. We await the result of work by the privacy community and industry to determine when such a response is appropriate and what form it should take. 

Children's Privacy

Our Service is not intended for and does not address anyone under the age of 16. We do not knowingly collect Personal Data from anyone under the age of 16. If you are aware that a child has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from anyone under the age of 16, we will take steps to remove that information from our servers. We do not knowingly sell or share (as those terms are used in the CCPA) the Personal Data of minors under 16 years of age. 

Links to Other Websites

Our Service may contain links to other websites that are not operated by us. If you click on a third-party link, you will be directed to that third party's site. We strongly advise you to review the Privacy Policy of every site you visit. 

We have no control over and assume no responsibility for the content, privacy policies or practices of any third-party sites or services.

Changes to this Privacy Policy

We may update our Privacy Policy from time to time. When we do, we will revise the "Last updated" date at the top of this Privacy Policy, on this page. 

You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
